Criminal defense — from arraignment to resolution

Being charged is not being convicted. The state has to prove every element, and the process has rules it does not always follow. We defend misdemeanors and felonies across seven counties.

How a case moves

  • Arrest and release. Cited out, bailed out, or held. Each county sets its own bail schedule — the same charge can carry very different numbers depending on where you were arrested.
  • Arraignment. The first court date. Charges are read, a plea is entered, bail and release conditions are set. This is the point at which having a lawyer already involved changes the most.
  • Discovery and pretrial. We get the reports, the video, the recordings and the records, and go looking for what is missing or wrong. Most of the real work happens here.
  • Motions. To suppress evidence from an unlawful search or stop, to compel discovery the prosecution has not turned over, or to dismiss for insufficient evidence.
  • Resolution or trial. Dismissal, reduction, diversion, a negotiated plea, or a jury trial.

Misdemeanor or felony

Misdemeanors carry up to a year in county jail. Felonies carry more, and under California's realignment many are served in county jail rather than state prison. A large category — wobblers — can be charged either way, which means the charging decision is partly a negotiation, and reducing a felony to a misdemeanor is often a realistic goal even when dismissal is not.

What actually helps your case

Two things, both free. Do not talk to the police about the facts without a lawyer — you cannot talk your way out of a filed case, but you can talk your way into a worse one. And do not miss a court date; a failure to appear turns a manageable case into a warrant.

Beyond that: get us the paperwork early. The citation, the report number, the bail paperwork, any bodycam you were given. The earlier we are in, the more of the case is still moving.

Common questions

Criminal Defense — questions we get asked

Should I talk to the police?
Not about the facts, and not without a lawyer. You cannot talk your way out of a case that is already being built, and statements are the most common way a defensible case becomes an indefensible one.
What is a wobbler?
An offense that can be charged as either a felony or a misdemeanor. Because the charging decision carries discretion, reducing a felony wobbler to a misdemeanor is often a realistic goal even where an outright dismissal is not.
Do I have to appear at every court date?
For most misdemeanors your attorney can appear on your behalf under Penal Code 977, so you keep working. Felonies and certain hearings require you personally. We will tell you which dates are which.
What if I already missed a court date?
There is likely a bench warrant. That is fixable — we can often arrange to have it recalled and get you back on calendar — but it gets harder the longer it sits.
How much does a defense cost?
It depends on the charge, the county and whether the case resolves early or goes to trial. We quote it on the call, and the consultation is free.
