Probation violations

A violation hearing is not a new trial, and that is exactly the problem. Fewer protections, a lower bar for the prosecution, and your original sentence sitting there waiting to be imposed.

Why these hearings are harder than they look

  • No jury. A judge alone decides. California courts advise defendants of this directly: on a charge of violating probation there is a right to a hearing before a judge, but not to a jury trial.
  • A lower standard of proof. Not beyond a reasonable doubt — the standard at a violation hearing is considerably easier for the prosecution to meet.
  • Hearsay comes in far more freely than at trial.
  • The sentence is already there. If the judge suspended execution of a sentence when probation was granted, a violation can put that sentence into full force.

What the judge can do

On a finding, the court may make any disposition authorised by statute, weighing the nature of the violation and how you have performed on supervision overall. In practice:

  • Reinstate probation on the same terms — often with a warning
  • Modify it — added conditions, more classes, community service, a short custody term
  • Revoke and sentence — the outcome we work to avoid

Formal or summary probation

Formal probation means a probation officer and regular check-ins. Summary (also called informal or conditional) has no officer — you complete your terms and obey the law. Either way, a violation can bring a bench warrant.

DUI probation runs long

DUI probation in California is 3 to 5 years and that is mandatory (Veh. Code 23600). The 2021 reform that capped most misdemeanor probation at one year does not apply to DUI — the Vehicle Code sets its own term. That is a long window in which a mistake becomes a violation.

And on DUI probation the limit is 0.01%, not 0.08%. One drink before driving is a violation on its own.

Common triggers

  • A new arrest — even without a conviction
  • A missed or failed test
  • Falling behind on fines or restitution
  • Not finishing DUI school or a required class in time
  • Missing a court date or a probation appointment
  • Driving on a suspended license
If you think you are about to violate, call before you do. Falling behind on classes or payments is often fixable in advance by asking the court to modify the terms. It is a different conversation once you are in violation.

Ending probation early

Under Penal Code 1203.3 a court can terminate probation early and modify its terms. It matters beyond the freedom — you generally cannot petition to clear your record while still on probation, so early termination is often the first step toward a dismissal.

Common questions

Probation Violations — questions we get asked

Do I get a jury?
No. A violation is decided by a judge alone. California courts advise defendants of exactly this: you have a right to a hearing, but not to a jury trial.
How hard is it for the prosecution to prove?
Easier than at trial. The standard of proof at a violation hearing is lower than beyond a reasonable doubt, and hearsay comes in far more freely.
What can the judge do?
Reinstate probation on the same terms, modify it with added conditions or a short custody term, or revoke it and impose the sentence. Where execution of a sentence was suspended, a violation can put that sentence into full force.
Is a new arrest automatically a violation?
It can support one even without a conviction, because the standard of proof is lower. That is why the violation and the new case have to be handled together, not separately.
Can I get off probation early?
Often. Penal Code 1203.3 lets a court terminate probation early and modify its terms. It also matters because you generally cannot petition to clear your record while still on probation.
